At ACS Car, we believe in transparent service. Below, you'll find detailed information regarding our operational policies, your responsibilities as a passenger, and our commitments to you. These guidelines are designed to ensure safety, punctuality, and a high-quality experience for everyone.

ACS CAR – Chauffeur Service & Private Hire

1. Acceptance of Terms

By accessing this website, making a booking (whether online, by telephone, SMS, email, or any other method), or using any services provided by ACS CAR, you agree to be legally bound by these Terms and Conditions.

If you do not agree to these Terms, you must not use our website or services.

These Terms constitute a legally binding agreement between the Customer and ACS CAR (the “Company”), a United Kingdom Private Hire Operator operating under applicable UK licensing regulations.

2. Regulatory Compliance

ACS CAR operates in accordance with the relevant UK Private Hire legislation and local licensing authority regulations.
All vehicles are insured under valid Hire & Reward insurance policies, and all drivers hold the appropriate Private Hire licences required by law.

3. Bookings and Contract Formation

A contract between the Customer and ACS CAR is formed when:
• A booking is confirmed by us (verbally or in writing), and
• A booking reference or confirmation is issued.

All bookings are subject to availability.

The Customer is responsible for ensuring that all booking details (date, time, pickup address, destination, passenger numbers, luggage requirements, special assistance needs, etc.) are accurate.

4. Website Use

By using this website, you confirm that:
• You are at least 18 years of age.
• You will not misuse the website for fraudulent or unlawful purposes.
• All information provided is accurate and complete.

We reserve the right to suspend or deny access to the website where misuse is suspected.

5. Fares and Additional Charges

All quoted fares are based on the journey details provided at the time of booking.

The following are not included in the base fare unless explicitly stated:
• Airport drop-off fees
• Car parking charges
• London Congestion Charge
• ULEZ or other clean air zone charges
• Dartford Crossing fees
• Silvertown Tunnel charges
• Any other road tolls or statutory charges

Such charges will be added to the final fare where applicable.

For long-distance journeys (over 50 miles), mileage rates apply as published at the time of booking.

We reserve the right to amend pricing in case of manifest error or incorrect quotation.

6. Waiting Time Policy

Waiting time is chargeable as follows:
• Standard pickups: 15 minutes free, thereafter charged at the prevailing hourly rate.
• Airport pickups: 60 minutes free from actual landing time, thereafter charged at the prevailing hourly rate plus parking costs.
• Hospital or meeting appointments: charged at the prevailing hourly rate unless otherwise agreed.

Waiting charges will apply where the passenger is not ready at the agreed pickup time.

7. Cancellation Policy

Cancellation charges apply as follows:
• More than 12 hours before pickup: No charge.
• Between 12 and 3 hours before pickup: 30% of the agreed fare.
• Less than 3 hours before pickup or No Show: 50% of the agreed fare.

Failure to answer phone calls or failure to appear at the pickup location within the free waiting period may be treated as a No Show.

Refunds, where applicable, will be processed within a reasonable timeframe.

8. Passenger Conduct

Passengers must:
• Not smoke, vape, consume alcohol, or eat considered high-risk for soiling inside the vehicle.
• Not behave in a threatening, abusive, or unsafe manner.
• Not cause damage to the vehicle interior or exterior.

A cleaning or soiling charge (minimum £120) will apply where professional cleaning is required.

Passengers are fully liable for any damage caused, and the Company reserves the right to pursue recovery of costs through legal action if necessary.

9. Safety and Door Opening Liability

Passengers must not open vehicle doors until the driver confirms it is safe to do so.

If a passenger opens a door in traffic and causes injury to a third party (including cyclists or pedestrians) or damage to property, the passenger shall be fully liable for all resulting losses, damages, penalties, and legal costs.

10. Limitation of Liability

To the fullest extent permitted by English law:
• ACS CAR shall not be liable for missed flights, appointments, examinations, cruises, or any consequential or financial loss arising from traffic congestion, road closures, weather conditions, accidents, or vehicle breakdown.
• We do not accept liability for delays outside our reasonable control (Force Majeure events).

Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under UK law.

11. Flight Monitoring and Airport Transfers

While we monitor flight arrivals, it remains the passenger’s responsibility to provide accurate flight details.

We are not liable for delays caused by incorrect flight information provided by the Customer.

12. Refusal of Service

We reserve the right to refuse service where:
• Passenger conduct poses a safety risk.
• Payment is refused or disputed without justification.
• The booking is deemed fraudulent or unlawful.

13. Data Protection

We process personal data in accordance with UK GDPR and the Data Protection Act 2018.
Customer information is used solely for booking, service provision, and legal compliance purposes.

14. Amendments to Terms

ACS CAR reserves the absolute right to amend, update, or modify these Terms and Conditions at any time without prior notice.

Any updated Terms will be published on our website and shall take immediate effect upon publication.

Continued use of our website or services after any amendments constitutes acceptance of the revised Terms.

15. Governing Law and Jurisdiction

These Terms and any dispute arising from them shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction.
